Kindred — Terms of Service

⚠️ Owner: this is a starter draft, not legal advice. It covers the App Store / Play Store / UK consumer law basics so you can publish a URL during phase 4 development. Have a solicitor review it before phase 10 public release.
1. Agreement
By creating a Kindred account or using the Kindred app, you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use Kindred.
These Terms form a binding contract between you (“you”, “your”) and Jay Tanna (“Kindred”, “we”, “our”, “us”).
2. Who can use Kindred
You may use Kindred if:
- You are 16 or older (or the age of digital consent in your country, whichever is higher).
- You have the legal capacity to enter into a contract.
- You agree to follow these Terms and applicable laws.
An adult account holder may add a “child” role for a family member under 16 to view shared household content (chores, meal plans). The adult is responsible for that child’s use of the app.
3. Your account
When you create an account:
- Provide accurate information (real email, real name).
- Keep your sign-in credentials confidential. You are responsible for activity on your account.
- Notify us immediately at support@kindredhome.app if you suspect unauthorised access.
- Use only one account per person.
You can delete your account any time in Settings → Account → “Delete my account”. Deletion removes your personal data within 30 days, per our Privacy Policy.
4. What Kindred does
Kindred helps your household plan meals, share shopping lists, divide chores, and store recipes. The exact set of features available to you depends on your subscription tier (Free, Premium, or Max — see §6).
We may add, change, or remove features at any time. We will give reasonable notice of changes that materially reduce what’s included in your paid subscription, and where required by law, offer a pro-rata refund.
5. Acceptable use
You agree NOT to:
- Use Kindred for anything illegal or that violates someone else’s rights.
- Upload content that is unlawful, harassing, hateful, infringing, or invades someone’s privacy.
- Harvest, scrape, or copy other users’ data.
- Reverse-engineer, decompile, or attempt to derive source code from the app, except to the extent permitted by law.
- Interfere with or disrupt the service (e.g. attacks, automated abuse, spam).
- Resell or commercially exploit Kindred without our written permission.
- Share your account credentials with people outside your household.
We may suspend or terminate your account if you breach these rules. We will tell you why, except where doing so would compromise an ongoing investigation or violate the law.
6. Subscriptions and payments
Kindred offers three tiers: Free, Premium, and Max. Premium and Max are paid subscriptions sold via the Apple App Store and Google Play Store.
6.1 Pricing
Current prices are shown in the app on the upgrade screen and in the App Store / Play Store listing. Prices may differ by country and are inclusive of applicable taxes (e.g. UK VAT).
6.2 Auto-renewal (Apple App Store users)
- Payment is charged to your Apple ID at confirmation of purchase.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours prior to the end of the current period.
- You can manage or cancel subscriptions in your Apple ID Account Settings after purchase.
- Any unused portion of a free trial is forfeited when you purchase a subscription.
6.3 Auto-renewal (Google Play users)
- Payment is charged to your Google Play account at confirmation of purchase.
- Subscriptions automatically renew unless cancelled before the end of the current period.
- You can manage or cancel subscriptions in Google Play → Subscriptions.
6.4 Free trials
We may offer a free trial period (currently 7 days on annual plans for new subscribers). At the end of the trial, the subscription auto-renews at the listed price unless you cancel beforehand.
6.5 Refunds
- Apple App Store: refund requests are handled by Apple. Submit at https://reportaproblem.apple.com/. Apple’s refund policy applies.
- Google Play: refund requests are handled by Google. Submit at https://play.google.com/store/account/orderhistory. Google’s refund policy applies.
- We do not process refunds directly. If Apple or Google decline a refund and you believe you are entitled to one under UK or EU consumer law, contact us at support@kindredhome.app.
6.6 Right to cancel (UK / EU consumers)
You normally have a 14-day right to cancel a digital service contract under UK and EU consumer law. By starting to use a Premium or Max feature during this period, you expressly consent to immediate performance and acknowledge that you lose the right to cancel once the feature is used. You can still cancel auto-renewal at any time via the App Store or Google Play.
6.7 Tier downgrades and cancellation
If you cancel or downgrade:
- Your paid features remain active until the end of the current billing period.
- After that, your account moves to the lower tier or Free.
- Content stored above the new tier’s caps remains visible but read-only until you delete content or re-upgrade.
7. Your content
You retain ownership of the content you create in Kindred (recipes, meal plans, photos, shopping lists, chores, notes — “Your Content”).
You grant us a worldwide, non-exclusive, royalty-free licence to host, store, transmit, and display Your Content solely for the purpose of operating Kindred for you and your household members. This licence ends when you delete the content or your account, except where retention is needed for backups (up to 30 days) or legal compliance.
You are responsible for Your Content. You confirm you have the right to upload and share it.
8. AI features
Kindred’s AI features (recipe import, meal-plan generation) use third-party AI services (currently Anthropic’s Claude). When you use them:
- The recipe URL, photo, or planning request you submit is sent to the AI provider for processing.
- The AI’s output is generated automatically and may contain errors, omissions, or unsafe suggestions (e.g. incorrect cooking temperatures, allergen oversights).
- You are responsible for reviewing AI-generated content before relying on it. Always verify ingredients, allergens, and cooking instructions.
- We do not guarantee the accuracy, completeness, or safety of AI-generated content.
- AI usage is metered per tier (see in-app limits). Excess usage may require an upgrade.
If you use Bring Your Own Key (BYOK, Max tier only), your Anthropic API key stays on your device and is sent only to Anthropic. Anthropic’s terms apply to usage under your key.
9. Service availability
Kindred is provided on an “as available” basis. We aim for high uptime but we do not guarantee that the service will be uninterrupted, error-free, or available in all locations. We may schedule maintenance windows or take the service offline for security reasons; we will give reasonable notice where possible.
10. Third-party services
Kindred uses third-party services to operate (Google Firebase, Anthropic, RevenueCat, Apple, Google). These have their own terms, which apply when you use Kindred. We are not responsible for third-party services we do not control.
11. Termination
You may stop using Kindred at any time and delete your account in Settings → Account.
We may suspend or terminate your account if:
- You materially breach these Terms.
- We are legally required to.
- We discontinue Kindred (we will give at least 30 days’ notice and offer a data export).
On termination, paid features stop. Where you have paid in advance for a period, we will refund the unused portion unless your account was terminated for breach of §5.
12. Disclaimers
To the maximum extent permitted by law:
- Kindred is provided “as is” and “as available” without warranties of any kind, express or implied (including merchantability, fitness for purpose, non-infringement).
- We do not warrant that Kindred will meet your requirements or be free from defects, viruses, or unauthorised access.
- AI-generated content is provided without warranty (see §8).
Nothing in these Terms limits or excludes liability where it cannot be limited or excluded by law (e.g. for death or personal injury caused by negligence, fraud, or your statutory consumer rights under UK or EU law).
13. Limitation of liability
Subject to §12:
- We are not liable for indirect, incidental, special, consequential, or punitive damages.
- Our total liability to you for any claim arising out of or relating to these Terms or Kindred is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim, or £100, whichever is greater.
This limitation does not apply where you are a UK or EU consumer and the law in your country gives you stronger rights.
14. Indemnity
You agree to indemnify Kindred against any third-party claims arising out of:
- Your breach of these Terms.
- Your Content.
- Your use of Kindred in a way that violates applicable law or another person’s rights.
15. Changes to these Terms
We may update these Terms when we add features or are required to by law. The “Effective date” at the top will reflect the most recent change. Material changes will be notified in-app at least 14 days before they take effect. Continuing to use Kindred after the changes take effect means you accept them.
16. Governing law and disputes
These Terms are governed by the laws of England and Wales. Disputes will be heard by the courts of England and Wales, except that consumers may bring proceedings in the courts of the country where they live and may rely on mandatory rules of consumer protection law in their country of residence.
If you have a complaint, please contact us first at legal@kindredhome.app so we can try to resolve it directly.
17. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about Kindred.
- Severability. If any provision is unenforceable, the rest remains in effect.
- No waiver. Our failure to enforce a right is not a waiver of it.
- Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets, on notice to you.
